In a rapidly changing environment, disciplinary schemes require to meet appropriate standards of objectivity and comply with relevant legislation, including Human Rights legislation. It is critical not only that disciplinary schemes are carefully drafted, reviewed and audited, but also that those involved in implementation, including case officers, investigators and panel members, are fully briefed on relevant legal developments and are trained and proficient in the requirements of fair process.
Our training courses cover the full range of legal issues relevant to Professional Regulation. We offer a range of modules, which can be combined to construct a bespoke training package, according to your specific needs. The modules include the following areas:
- Designing and auditing disciplinary processes – practical training for those involved in constructing disciplinary processes which meet current standards in terms of objectivity and transparency, which are legally compliant and achieve the objectives and functions of the professional body in its regulatory role. We can also advise and assist with the drafting of disciplinary schemes and the auditing of existing schemes with a view to ensuring legal compliance
- Case officers/ investigators – taking a practical approach, we look at the role and responsibilities of the case officer or investigator, recognising the importance of the requirements of fairness and balancing the interests of the individual member with the regulatory responsibilities of the professional body
- Tribunal/ panel members – we recognise the very important but challenging role which is undertaken by those involved in adjudicating upon disciplinary cases, often in the glare of the public spotlight. Emphasis is placed upon the practical implications of the requirements of fairness and transparency, including decision-making, the standard of proof, weighing and assessing evidence, including mitigating evidence, dealing with witnesses to fact and experts, the role of the legal assessor, giving reasons and drafting decisions
- Communication skills – we provide practical skills in effective communication in a sometimes difficult and adversarial environment. Aimed principally at complaint handlers, but relevant also to all of those involved in the disciplinary process, we offer practical insight and training in communication skills and techniques which are essential for the effective running of any disciplinary process.
