Pensions and Insolvency: The impact of pension deficits on company restructurings

Many companies remain responsible for substantial pension liabilities, often a legacy from large workforces employed in the past with an entitlement to valuable salary related benefits. Mounting deficits and the increasing regulation of pension schemes has put additional pressure on companies otherwise struggling in difficult trading conditions. For some, this has increased the risk of insolvency; for others, it has caused problems for groups looking to restructure. Insolvency might allow a scheme to be rescued by the pension protection fund, but this is likely to be a 'no win' situation for other affected parties. However, collaborative working amongst the stakeholders concerned (including the Pensions Regulator) as well as the use of innovative techniques can turn round an otherwise hopeless situation and save jobs in the process.

Speakers

Paul Hally is head of the Restructuring and Insolvency Group. He has practised in the area for 23 years and has been a Licensed Insolvency Practitioner for more than 18 years.

Edwin Mustard is a partner in Shepherd and Wedderburn's Pensions Group. He advises trustees, employers and insolvency practitioners on all aspects of pensions law and has advised on various pensions-led corporate restructurings under the new pensions regime.

Brenda Harris leads the Shepherd and Wedderburn London Restructuring and Insolvency Group. She has over 25 years of experience acting for banks, insolvency practitioners and corporate clients on a wide range of insolvency related issues.
