Collaborating for business success
Leading UK law firm Shepherd and Wedderburn will give companies an exclusive insight into the benefits and pitfalls of business collaborations during a seminar in Aberdeen on Thursday (19 April 2007).
Organisations looking to improve their market position are increasingly joining forces with other companies to achieve their aims, whether it's oil companies maximising recovery from reserves, pharmaceutical companies developing new products or universities forging closer links with industry.
The seminar will explain the different ways of collaborating including: an overview of collaborations; the best ways to structure partnership working, with an emphasis on intellectual property and commercial results; responsibility for staff and consultants and an outline of competition law.
Graeme Moffett, from Shepherd and Wedderburn said: "There are many reasons why collaborating is an attractive prospect for companies. Often, a project may be beyond the capabilities of a single business, either because it doesn't have the capital investment needed or because it lacks the technical expertise to carry out the project.
"A number of important legal issues are inevitably raised during collaborations, particularly relating to the ownership and exploitation of intellectual property rights. Joint ownership of intellectual property and results is often seen as an easy solution, but it can just as easily turn out to be a legal and financial nightmare.
"Collaborations frequently involve competitors, which can call into question whether the relationship is allowed under competition laws. These relationships have become so central to many businesses, both in strategic and financial terms, that it’s essential to ensure they are valid and enforceable.”
