A recent decision by the Pensions Ombudsman in the case of Mrs H Curran against IBC Pension Trustees Limited is of interest with respect to the thorny issue of whether trustees should record reasons for their decisions. The facts of the Curran case (which led to a finding of trustee maladministration) are interesting and undoubtedly unusual but it is not uncommon for trustees to be faced with exercising their discretion in complex circumstances. Whether trustees should give reasons for their decisions is a grey area because, as explained below, the views of the Pensions Ombudsman and the courts appear to differ, leaving trustees unsure how best to proceed.
